Definitions

Services: LABORATOIRES COSMETIQUES ET PARFUMEURS ASSOCIES makes available to Users or Customers the website https://www.lamaisondelavanille.com.
Content: All elements constituting the information present on the Site, in particular text, images, and videos.
Customer Information: Hereinafter referred to as “Information(s)”, meaning all personal data that LABORATOIRES COSMETIQUES ET PARFUMEURS ASSOCIES may hold for the management of your account, customer relations management, and for analysis and statistical purposes.

2. General Terms of Use of the Site and Services

The Site is an intellectual creation protected by the French Intellectual Property Code and relevant international regulations. The Customer may not in any way reuse, transfer, or exploit for their own benefit any or all elements or works on the Site.

Use of https://www.lamaisondelavanille.com implies full and unconditional acceptance of these terms of use, which may be modified or supplemented at any time. Users are therefore invited to consult them regularly.

The Site is normally accessible at all times. However, the Owner may decide to interrupt access for technical maintenance, in which case it will endeavor to inform users in advance of the dates and times of the intervention. The Site is updated regularly by the responsible party, who may also modify these legal notices at any time; such changes bind the User, who should refer to them as often as possible.

3. Description of Services Provided

The Site’s purpose is to provide information concerning all activities of the Company. 5. Intellectual Property and Infringements

Any reproduction, representation, modification, publication, adaptation, in whole or in part, by any means or process, is prohibited without prior written authorization from the Owner.

Unauthorized exploitation of the Site or any of its elements constitutes infringement and will be prosecuted under Articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitation of Liability

The Owner acts as publisher of the Site and is responsible for the quality and truthfulness of the Content it publishes.

The Owner cannot be held liable for direct or indirect damage to user equipment arising from Site access, resulting from use of non-compliant equipment as described in Section 4, or from bugs or incompatibilities.

The Owner cannot be liable for indirect damages (e.g. loss of market or loss of opportunity) resulting from use of the Site. Interactive spaces (e.g. contact forms) are available to users; the Owner reserves the right to remove, without prior notice, any content that contravenes applicable French law, particularly data protection provisions. The Owner may also pursue civil and/or criminal liability of the user for racist, defamatory, or pornographic messages.

7. Management of Personal Data

The Customer is informed of the regulations concerning marketing communications, the Law of 21 June 2014, the French Data Protection Act of 6 August 2004, and the GDPR (Regulation 2016/679).

7.1 Data Controller

For Personal Data collected in connection with account creation and Site navigation, the data controller is LABORATOIRES COSMETIQUES ET PARFUMEURS ASSOCIES, represented by its legal representative, Stéphane Lawyee.

As data controller, LABORATOIRES COSMETIQUES ET PARFUMEURS ASSOCIES undertakes to comply with legal requirements, establish processing purposes, inform prospects and customers upon collecting consent, and maintain an accurate processing register. Upon learning of a User’s death and absent instructions, the Owner will destroy data unless required for legal or probative purposes.

8. Incident Notification

No Internet transmission or electronic storage method is fully secure; absolute security cannot be guaranteed. In the event of a security breach, affected users will be notified so they can take appropriate measures. Notification procedures comply with national and EU legal obligations. The Owner commits to fully informing clients of any account security issues and providing necessary information to meet their own reporting obligations.

No User personal data are published, exchanged, transferred, assigned, or sold without consent, except in the event of a sale of the Owner, in which case the acquirer would be bound to the same data obligations.

9. Hyperlinks, Cookies, and Web Beacons

10. Applicable Law and Jurisdiction

Any dispute relating to use of the Site is governed by French law. Unless otherwise required by law, exclusive jurisdiction is granted to the courts of Salon-de-Provence.
